The ?BadFaith? in Branding Laws (?BadFaith? dalam Hukum Merek) by Dr. Henry Soelistyo, S.H., LL.M. was conducted on April 24th<\/sup>, 2018, in UPH?s Graduate Campus, Plaza Semanggi, Jakarta. <\/span>The ?BadFaith? in Branding Laws (?BadFaith? dalam Hukum Merek) by Dr. Henry Soelistyo, S.H., LL.M. was conducted on April 24th<\/sup>, 2018, in UPH?s Graduate Campus, Plaza Semanggi, Jakarta. This book is a response to the breach of the brand registration procedures happening. His involvement in the Bill of Branding in the beginning of the 1990s is the beginning of Henry?s calling and his concern for this phenomenon. Henry is now the Head of the Graduate and Postgraduate Schools of Law at Universitas Pelita Harapan (UPH).<\/span><\/span><\/p>\n

 <\/p>\n


Henry also explained the other reasons he is concerned with this theme. First, he has been involved in a number of scholarly discussions in academic seminars that let him know other people?s opinions concerning the phenomenon surrounding Bad Faith.<\/em> Second is his real-life experience as a seasoned witness in court concerning the Intellectual Property Rights (Hak Kekayaan Intelektual (HKI)).<\/span>

 \"IMG_0338.jpg\"<\/td>\n ?Every discussion creates a new problem to narrow down the issue of how to investigate whether there is good faith when an offer of the brand name is made. In other words, one cannot really detect bad faith in these cases. Because of this, there are always manifestations that need to be interpreted,? Henry explained.<\/span> <\/p>\n

Henry in this book review session notes that in any situation, the concept of bad faith will always be bad.<\/span><\/p>\n

 <\/p>\n

?This extremely bothering issue made me want to deliberately explore this theme with a provocative title. My involvement in the making of the Branding Bill taught me that the planning of both good and bad faith is far from easy. In fact, the proving propositions in court concerning their case is the main topic of this book,? Henry continued.<\/span><\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n

In this book discussion, in addition to explaining why he wrote the book, Henry also conducted several different discussions, one of them being Bad Faith in system registry. Here, he emphasized that a branding office has to be an advanced filter in the brand naming process. He also explained the requirements and procedures that have to be fulfilled by requesters.<\/span> <\/span><\/p>\n<\/p><\/div>\n<\/p><\/div>\n<\/td>\n<\/tr>\n

In response to this book review, UPH Rector, Dr. (Hon) Jonathan L. Parapak, M.Eng,Sc., expressed that this particular book is a crucial thing for Indonesia.<\/span><\/p>\n

?Protecting the right for intellectual property is extremely crucial these days, especially in the digital era, which is developing rapidly. This is also the concern of the Kemenristekdikti (the Ministry of Research, Technology, and Higher Education) I attended last week, which discussed the making of a cyber institution. This is also certainly crucial for the academic realm,? expressed the Rector.<\/span> <\/span> <\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n

Dr. Cita Citra Winda, a representative of AKHKI (Asosiasi Konsultan Hak Kekayaan Intelektual Indonesia) (the Association of Intellectual Property Consultants), is in agreement, expressing herself her happiness for the success of his friend, Henry.<\/span><\/p>\n<\/p><\/div>\n

?I appreciate and am really proud of Henry, my colleague, who already explored the motives of bad faith in their registration and ownership, and did it holistically and in-depth, along with a relevant case study. Surely this book will be able to supplement discussions concerning laws of intellectual property and is able to be a topic discussed both in the academic world and professionally. Especially for HKI legal practitioners in the preparation of legal opinions and advice,? said Dr. Cita.<\/span><\/p>\n<\/td>\n<\/tr>\n<\/tbody>\n<\/table>\n

Through this book discussion, UPH hopes that the participants who come from the various circles such as students, practitioners, lecturers and public increasingly have the equipped knowledge related to intellectual property law, and useful both academically and professionally.<\/span><\/p>\n

In addition to Henry?s book review, in this event, there was also conducted a signing of the Memorandum of Understanding (MoU) for the collaboration between UPH?s Graduate Law School with law institutions in the government, associations, and professionals. There was a total of 16 MoUs officially signed by UPH Graduate Law School, where 10 were signed at the time, and 6 others were signed separately.(mt)<\/span>
