In Bill Draft (Rancangan Undang-undang/RUU) for Legal Aid, the existence of Consulting and Legal Aid Institutions is unclear.

In Bill Draft (Rancangan Undang-undang/RUU) for Legal Aid, the existence of Consulting and Legal Aid Institutions (Lembaga Konsultasi dan Bantuan Hukum/LKBH) is unclear. Even it can be said that the status of this institution is not recognized by the government, based on one of the Bill substance. With this uncertainty, it would be difficult for LKBH to be accommodated and can not function properly because of the questionable legality.
This is what the subject of discussion in the Focus Group Discussion (FGD), entitled “Advocacy for Legal Aid Bill to Strengthen Access for Legal Aid Marginal Society Justice through Campus LKBH.” The discussion was organized by UPH LKBH in cooperation with Indonesian Legal Resources Center (ILRC) on Thursday (15/04) in UPH Faculty of Law Moot Court, room D309-310.

This event begins with remarks by UPH Faculty of Law Dean Bintan Saragih. He has a hope that LKBH can ensconce at the university level and at faculty level. “At university level, LKBH act as an institution and in this way LKBH will be more resound. While on the faculty level, LKBH act as a service to the community,” he said with the intention that this institution can be more exist.
Bintan was also convey his ideals in order, “People do not take out any penny! We must help the law-blind people because any of the Indonesian people are equal before the law,” he continued. He and all the LKBH personnel agree that the lawyer or advocate can not be expected to defend the marginalized people. |
Furthermore, Head of UPH LKBH Jamin Ginting confirmed the existence of campus LKBH as one of the three pillars of Higher Education. “Campus LKBH existence is very important as a form of service to the community and the place of practice for law students. But, sadly enough that most of the court did not accept a student or faculty as a companion case law,” he continued.
To fight it, ILRC is not only cooperating with UPH LKBH, this FGD was also attended by several LKBH personnel from other campuses, like Universitas Trisakti, Universitas Parahyangan Bandung, Universitas Djuanda Bogor, Universitas Muhammadiyah Jakarta, dan Universitas Sahid Solo. “Legal Aid Bill Draft was also discussed by many institutions of civil society legal aid throughout |

Together they discussed the problems they face in their LKBH, primarily related to external parties and then the results of this FGD will be submitted to the Parliament (Dewan Permusyawarahan rakyat/DPR). “We’ve filed a request to meet with Commission III of the House and the struggle of LKBH existence as an input for the Draft,” said ILRC Executive Director Uli Parulian Sihombing.
All the participants hope that after the legalization of the Legal Aid Bill, LKBH can be better organized and government-recognized status. In addition, the National LKBH will help the financial of other LKBH that is less capable in assisting the public in legal cases because they focus is on service to the marginal community. (cyn) |
