Indonesia public start to feel concern for Indonesia medical services that begin to wane in quality, thus, the topic of malpractices are now often put into the spotlight of discussion. The malpractice cases themselves can happen due to the negligence or even deliberation conducted by the doctors. The cases then continue to trigger friction between doctors and patient, which will finally end up to law enforcement stage. Reaching this stage, the effect of the cases will widespread to many parties: professional doctors, patients, and also the hospitals.
This situation made Universitas Pelita Harapan Faculty of Medicine and Faculty of Law took initiative by holding a panel discussion in order to understand the clear picture of malpractice cases as well as the best solutions for the affected parties. Hopefully, by presenting an explanation of doctors? law protection in Indonesia, general public could get more insight and awareness on malpractices so that they can think in a more critical perspective of the cases as well as the law application in Indonesia.
The panel discussion featured 4 professional speakers in each of their respective fields. They are Prof. Gayus Lumbuun, SH. ,MH., Prof. Dr. Dr. dr. Eka Wahjoepramono, Sp., Dr. HP Panggabean, SH., MH., and Dr. Sabir Alwy, SH., MH.
Prof. Gayus opened the discussion by pointing out the topic ?medicine criminalization?. In his description, he disclosed the articles and laws that put dr. Ayu?s in predicament (the most recent malpractice that stirred Indonesia public). One of those articles and laws is the 55 KUHP article. The 55 KUHP articles state that the involved parties are eligible to law enforcement. dr. Ayu?s story has become a role model for other doctors to avoid committing the same cases as her.
On the other hand, Dr. Sabir presented the topic ?Ethical Codes, Standards of Medical Professions, and Medical Profession Dispute Approaches?. In his opinion, the profession and the disciplinary science of medical field should work synchronously. Therefore, an organization, MKDKI (Majelis Kehormatan Disiplin Kedokteran Indonesia), is established for the purpose of supervising the standards of Indonesia professional medical workers. The standard that has been determined by MKDKI should be upheld and understood by every professional doctor so that conflicts like malpractices can be avoided.
Prof. Dr. Dr. dr. Eka Wahjoepramono, Sp., delivered his presentation from the professional doctors? perspective. With the topic ?The Concept of Medical Risks and Defensive Medicine on Medical Practices in Indonesia?, Prof. Eka thought that cases like dr.Ayu?s can affect the defensive medicine or diagnostic actions or theraupetic actions that doctor could take as a mean of protection when facing the possibility of malpractice. Prof. Eka further added that Indonesia law currently cannot objectively protect the profession of doctors due to the limited perception from the law sides. ?Therefore, judges should fully understand that there are justifying factors. These justifying factors are supposedly able to eliminate the law suits,? Prof. Eka explained.
At the end of discission, Dr. Panggabean draw a conclusion that law should support the medical professions. He urged the needs of MKDKI so that Minister of Health could reevaluate the medical profession ethic codes. By doing so, medical workers could face problem, should it happens, from the aspect of sociology and psychology and at the same time maintain the medical professions? authority.
The discussion itself took place on Saturday, January 25, 2014 from 09.00 a.m. with the venue at UPH Karawaci, Building D Auditorium. About 300 participants from UPH Law and Medicine students, general public, students in Jabodetabek region, law practitioners and observers, organizations of doctors, as well as regional government officials came to the panel discussion.
