UPH Law School conducted an internal professorship for Dr. Frans Hendra Winarta, SH., MH as Professor and Dr. Jonker Sihombing, SE., SH., MH., MA., as Assistant Professor on 29 April 2015. Dr. Frans Hendra Winarta, is the founder of Frans Winarta & Partners (FWP) Law Firm and has been lecturing at UPH Law School since 1995 until present. He is an active legal and education practitioner, also in any arbitration activities locally and internationally, as well as having stellar achievements. While Dr. Jonker Sihombing, is a permanent lecturer at UPH Law School for undergraduate and graduate school. Currently, he is the Head Department of Master and Doctoral program at UPH. He is also active in education field by producing several research works.
Professor Dr. Frans presented a speech entitled ?PROCESS PRINCIPLES AND ARBITRATION PRACTICES IN INDONESIA THAT NEED TO BE ALIGNED WITH THE INTERNATIONAL RULES?. Frans emphasized on the Law of Indonesia National Arbitration as the law, governing the arbitration and dispute resolution alternatives, needs to conform to the principles of international arbitration, in order to ensure legal certainty in Indonesia and to meet the demand of dynamic business world. Moreover, if Indonesia is able to be an arbitration friendly nation, it can encourage a conducive investment climate in Indonesia, foreign or domestic, to settle the business disputes. ?If we ignore this, so we could not fulfill the demand of business stakeholders in the future,? said Frans. Finishing his speech, Frans quoted powerful words from John F. Kennedy, ?Change is the law of life. And those who look only to the past or present are certain to miss the future?.
Furthermore, Assistant Professor Dr. Jonker delivered a speech entitled ?THE CHALLENGES IN REGULATION AND SUPERVISION OF BANKING IN INDONESIA TOWARD ASEAN ECONOMIC COMMUNITY 2015?. He stated that an academic review is necessary concerning the end of the year, in which the Indonesia financial services and banking sector will be integrated with the existing banks in the ASEAN region. In addition, banking is one out of 12 economic sectors which is accelerating towards the free trade in AEC 2015. The monetary crisis on 1998/1999 became an initial momentum from the government debts to domestic sectors.
That time there was a currency crisis of rupiah against the US Dollar, which resulted the country to suffer bad credit and foreign exchange losses and led to insolvency. Jonker explained that the existence of Financial Service Authority (OJK), which contains the regulation, and supervision of banking is not entirely able to accommodate the needs towards the AEC 2015. The aspect of justice in the laws of OJK has not received serious attention. Thus, he suggested that all related aspects must receive proper attention so the banking industry in this nation could compete with other branches of foreign banks. One most important thing is to create a system of banking regulation and supervision that is able to strengthen the banking resiliency in Indonesia from contagion effect in the monetary and banking sector of neighboring countries.
At that moment, also attended and delivered a remark to this event, Professor Emeritus in International Criminal Law Universitas Padjajaran (UNPAD), Prof. Dr. Romli Atmasasmita, S.H., LLM. He stated that Professorship is an honorary degree given to academicians, including the practitioners who are also academicians. Professorship can also be awarded to the government officials whose services have been acknowledged by the nation. Prof. Romli expressed his admiration to both Professors that they have given big contributions in their field and deserved to earn Professor degree. ?Professor is an asset to the nation so for the two professors who have been sworn in hopefully could keep producing the beneficial works for the nation,? stated Romli.
Approximately 200 guests attended this Professorship event; they were leaders, lecturers, and UPH staffs, Professors from several law schools and legal practitioners, such as Prof. Em. Dr. Eddy Damian, SH., Catholic leader and Indonesia humanist, Prof. Dr. Franz Magnis Suseno, Universitas Indonesia Professor, Prof. Dr.Maria Farida Indrati, S.H., M.Hum and the 29th Minister of Law and Human Rights Republic of Indonesia, Amir Syamsuddin, relatives, and colleagues of both Professors.
