17 Universities in Indonesia Joining UPH Faculty of Law?s Dr. Mochtar Riady Legal Fair 2016

A total of 19 delegates from 17 universities competed in the national legal debate organized by the Student Association of UPH Faculty of Law (HMFH). This competition is part of ?Dr. Mochtar Riady Legal Fair? (DMRLF) series which took place for three days, on April 28-30 2016 at UPH Campus, Lippo Village, Tangerang. This biannual event is the fourth time HMFH is established and the theme carried this time is related to Asean Economic Community (AEC) issue which has been experienced by Indonesia these last four months, namely ?Embracing ASEAN Economic Community?.

 

 

This national level law debate competition aims to explore the best potential from law students throughout Indonesia in presenting arguments. This competition is fighting for the alternating Dr. Mochtar Riady trophy, which in DMRLF 2014 was achieved by Universitas Dipenogoro Faculty of Law.

 

 

From year to year, the number of competition enthusiasts keeps on increasing. Compared to DMRLF 2014 which was attended by 14 delegates from 12 universities, the increase in participants this year is quite significant, both from the number of delegates and participating universities. All 17 participating universities this time do not only come from the island of Java, but also from outside Java, such as Universitas Hasanuddin, Universitas Sumatera Utara dan UPH Medan. While other delegates come from Universitas Jayabaya, Universitas Sebelas Maret, Universitas Diponegoro, Universitas Islam Negeri Syarif Hidayatullah Jakarta, Universitas Padjajaran, Universitas Surabaya, Universitas Indonesia, Universitas Kristen Maranatha, Universitas Gadjah Mada, Universitas Pancasila, Universitas Airlangga, Unika Atma Jaya, Universitas Binus, dan Sekolah Tinggi Hukum Bandung.

 

 

Related to DMRLF 2016 theme, the committee gave 10 motion choices to be debated in the competition. Among others are:

 

1. Indonesia’s participation in the Trans-Pacific Partnership,

 

2. Arbitration as the Main Line Settlement for MEA,

 

3. The Immunity of BUMN Main Director in the Application of Business Judgment Rule,

 

4. The Legalization of Enterprise Establishment by Political Parties,

 

5. Ball-in as a Substitute for Ball-out Mechanism in Banking Crisis,

 

6. The Opening of Tourism Sector for Foreign Investment,

 

7. The Separation of Sharia Business Unit from Conventional Commercial Banks,

 

8. The Implementation of Extraterritorial Jurisdiction by the Commission (KPPU),

 

9. Providing Penalties for Obligatory State Wealth Report (LHKPN) Violation by the Commission,

 

10. The Retribution of Foreign Labor Use as the Locally-Generated Revenue.

 

Before undergoing the debate competition, on the first day, the participants attended a talk show to broaden the knowledge related to the theme of the event. The talkshow entitled ‘The Impact of the ASEAN Economic Community against Investing in Indonesia’ was delivered by Daniel Agustino, Senior Investigator of Business Competition Supervisory Commission, and Natalia Kentjana, Director of Promotion of Investment Coordinating Board Development.

 

 

On the second day, the participants began to follow stages of the debate competition up until the last day. To support this competition, the committee presented competent judges with practitioner, lecturer, as well as legal professional background, including Maju Simampra ? Board Director for Indonesian Advocates Association (PERADI) of Tangerang Branch, Agus Hariadi ? Expert Staff for the Relation between Ministry of Justice and Human Rights (Kemenkumham), Cindy Febriani ? Associate Director of Lippo Group, Udin Silalahi ? Lecturer of UPH Faculty of Law, and Novita Bachtiar ? Deputy director for International Relations and Cooperation of Financial Services Authority (FSA), as well as practitioners from other leading law firms. (mt)
